The Democratic Republic of Timor-Leste guarantee the right of asylum in accordance with the Genebra Convention of 1951 and the New York Protocol of 1967, to foreigners and stateless persons persecuted or is guaranteed seriously threatened of persecution in result of activity performed in State of nationality or habitual residence in favor of democracy, social and national liberation, peace among peoples, freedom and rights of the human person. It is also guaranteed the right of asylum to foreigners and stateless persons who, fearing justifiably be persecuted for reasons of race, religion, nationality, political opinion or membership of a particular social group, are unable or, owing such fear, unwilling to return to the State of nationality or residence habitual.
